Your use of the Mobile Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Mobile Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Mobile Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to our SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Us through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. We respect the intellectual property rights of others and encourage You to do the same. GOVERNING LAW AND JURISDICTION.

In the event that the arbitration provision below is held invalid or unenforceable, then any dispute with respect to these Terms shall be brought and heard in a court of appropriate subject matter jurisdiction located in Seattle County, Washington, applying the laws specified above. In such event, you consent to the in person am jurisdiction and venue of any such courts. DISPUTE RESOLUTION AND MANDATORY ARBITRATION; CLASS ACTION WAIVER.

The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND SHALL UNDER NO CIRCUMSTANCE BE CONDUCTED ON A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION BASIS. The foregoing class action waiver applies to any and all Claims, regardless of the nature of any such Claims. Pre-Arbitration Claim Resolution
For all Claims, whether pursued in court or arbitration, You must first give Us an opportunity to resolve the Dispute which is first done by emailing Us at legal@thehouseoflrc.com the following information: (1) Your name, (2) Your address, (3) A written description of Your Claim, and (4) A description of the specific relief You seek. If We do not resolve the Dispute within 45 days after receiving Your notification, than You may pursue Your Claim in arbitration. You may pursue Your Claim in a court only under the circumstances described below.
Exclusions from Arbitration/Right to Opt Out
Notwithstanding the above, Your or We may choose to pursue a Dispute in court and not by arbitration if: (a) The dispute qualifies for initiation in small claims court; or (b) YOU OPT-OUT OF THESE ARBITRATION PROCEDURES WITHIN 30 DAYS FROM THE DATE THAT YOU FIRST CONSENT TO THESE TERMS (the “Opt-Out Deadline”). You may opt-out of this Provision by emailing Us at legal@thehouseoflrc.com the following information: (1) Your name; (2) Your address; (3) A clear statement that You do not wish to resolve disputes with Us through arbitration. Either way, We will not take any decision You make personally. In fact, We promise that Your decision to opt-out of this Arbitration Provision will have no adverse effect on Your relationship with Us. But, We do have to enforce the Opt-Out Deadline so keep in mind that any opt-out request received after the Opt-Out Deadline will not be valid and You must pursue Your dispute in arbitration or small claims court.
LANGUAGE.
The Parties hereto have expressly required that these Terms and all documents and notices relating thereto be drafted in the English language.

These Terms constitute the entire agreement between You and Us with respect to matters set forth in these Terms and supersede any prior or contemporaneous understanding or agreement; and there are no third-party beneficiaries to these Terms. If any provision of these Terms is deemed invalid or unenforceable, that provision will be reformed and construed consistently with applicable law as nearly as possible to reflect the original intentions of these Terms; and in any event, the remaining provisions of these Terms will remain in full force and effect. No waiver of any of the provisions of these Terms is a waiver of any other provision, whether or not similar, nor does any waiver constitute a continuing waiver.
